Comstock Township and Officials Sued Over Constitutional Violations and State Law Claims.


Kustra & Bloom PLC has been retained by Soil Friends LLC to pursue claims against Comstock Charter Township and several Officials for constitutional violations and state law claims. The federal lawsuit filed by Soil Friends LLC comes on the heels of ongoing persecution of the small family farm and cidery by Comstock Township and individuals within the Township.

As alleged in the Complaint, Defendants, in combination, conspired to utilize their positions as governmental units or within government to ensure that Soil Friends LLC would be unable to operate, preventing Soil Friends LLC from continuing their lawful enterprise permitted by state law. As a result of the conspiracy and Defendants’ illegal, wrongful, or tortious acts, Soil Friends LLC sustained damages including loss of revenue from their business, loss of product, loss of business relationships and/or expectancies, and a loss of personal and business reputation within the community and across the state of Michigan.

The 12-count Complaint alleges the following:

  • REGULATORY TAKINGS (Fifth and Fourteenth Amendment)

  • CONSPIRACY TO INTERFERE WITH CIVIL RIGHTS (42 U.S.C. § 1985)

  • STATE LAW PREEMPTION BY MICHIGAN LIQUOR CONTROL CODE

  • STATE LAW PREEMPTION BY MICHIGAN RIGHT TO FARM ACT

  • TORTIOUS INTERFERENCE WITH A BUSINESS RELATIONSHIP

  • DEFAMATION UNDER STATE LAW

  • VIOLATION OF MICHIGAN’S OPEN MEETINGS ACT

  • INTENTIONAL INFLICTION OF EMOTIONAL DISTRESS UNDER STATE LAW

  • CIVIL CONSPIRACY
